L&#8217;iniziativa, guidata dall&#8217;avvocato Marc Barennes, contesta le commissioni elevate e le clausole contrattuali considerate sleali imposte dalla piattaforma olandese. La recente sentenza della Corte di Giustizia dell&#8217;Unione Europea (C-264\/23) del settembre 2024 ha invalidato le cosiddette &#8220;clausole di parit\u00e0&#8221;, aprendo la strada a questa azione legale. ?(Kluwer Competition Law Blog)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La piattaforma actioncollectivehotel.fr<\/h2>\n\n\n\n<p>Per facilitare la partecipazione degli albergatori, \u00e8 stata creata la piattaforma <a href=\"https:\/\/actioncollectivehotel.fr\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">actioncollectivehotel.fr<\/a>, che invita gli hotel che hanno collaborato con Booking.com tra il 2015 e il 2024 a unirsi all&#8217;azione. L&#8217;obiettivo \u00e8 valutare i danni subiti e richiedere un risarcimento, che per gli hotel indipendenti pu\u00f2 raggiungere decine o centinaia di migliaia di euro, mentre per le catene alberghiere pu\u00f2 arrivare a milioni. Si stima che le perdite totali per la sola Francia ammontino a circa 1,5 miliardi di euro. ?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Dominio di Booking.com nel mercato online<\/h2>\n\n\n\n<p>Booking.com detiene una posizione dominante nel mercato delle prenotazioni online. Secondo dati di D-Edge, nel 2024 solo il 33% del fatturato online degli hotel proveniva da prenotazioni dirette, con il resto distribuito attraverso piattaforme come Booking.com ed Expedia. In Francia, Booking.com rimane la scelta principale per le prenotazioni alberghiere, superando anche Airbnb. ?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Espansione dell&#8217;iniziativa in Europa<\/h2>\n\n\n\n<p>L&#8217;azione legale non si limita a Francia e Spagna. Sono in corso consultazioni con studi legali in Italia, Portogallo e altri paesi, con l&#8217;obiettivo di coordinare un attacco europeo contro Booking.com. Se il fronte si rafforza, potrebbe causare profondi cambiamenti nel commercio turistico online. ?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Implicazioni per gli albergatori italiani<\/h2>\n\n\n\n<p>Per gli albergatori italiani, questa iniziativa rappresenta un&#8217;opportunit\u00e0 per rivendicare maggiore autonomia e condizioni pi\u00f9 eque nelle prenotazioni online.
